Message is stated otherwise. A deposit is your guarantee that it is sold, & his guarantee that you are not selling it to someone else. You each have made one guarantee here. You guaranteed you wouldn't sell it to someone else, & he guaranteed he was going to finish paying for it. If you broke your guarantee, & sold it to someone else, you should refund the money. If he broke his guarantee, & didn't finish paying for it, you should not refund it. You lived up to your guarantee, & he didn't.
